Welcome to Klar. These Terms of Service ("Terms") govern your access to and use of the Klar application for iOS and macOS, as well as the website located at useklar.online (collectively, the "Service").

By downloading, installing, or using Klar, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Service Operator & Eligibility.

The Service is provided and operated by Jakub Mieczkowski ("we", "us", or "our").

You must be at least 13 years old (or the minimum legal age required in your jurisdiction) to use Klar. By using the Service, you represent that you meet this age requirement.

2. Description of the Service.

Klar is a voice-first writing and dictation assistant designed for iPhone and Mac. Klar converts your spoken voice into formatted, clean text that can be pasted or inserted directly into text fields and applications.

3. User Content & Intellectual Property.

• Your Ownership: You retain 100% full ownership of all audio you record, dictations you submit, and text generated by Klar. We claim no intellectual property rights or copyright over your content or transcribed text.
• Klar Intellectual Property: All rights, title, and interest in and to the Klar application, software code, user interface designs, wordmarks, visual components, and logos are and remain the exclusive property of Jakub Mieczkowski.

4. Subscriptions, Pricing & In-App Purchases.

A. Plans & Free Tier

Klar offers a free tier (e.g., up to 1,000 words per week) as well as premium paid subscriptions ("Klar Pro"). Details regarding current pricing and features are available within the app and on our pricing page.

B. Purchases & Billing

How your Klar Pro purchase is processed depends on your platform:

• iPhone (iOS): Purchases, trial periods, and subscriptions are processed securely through the Apple App Store using your Apple ID account. Payment is charged to your Apple ID account.
• Mac: Because the Mac app is distributed outside the App Store, purchases are processed securely through Stripe via our web checkout. Payment is charged to the payment method you provide at checkout.

In both cases Klar never receives or stores your card details, and we use RevenueCat, Inc. to manage and verify your subscription across your devices.

C. Automatic Renewal & Cancellation

Subscriptions automatically renew unless canceled before the end of the current billing period. You can cancel at any time:

• iPhone (iOS): in your Apple ID Account Settings on your device.
• Mac: through the billing-management link in Klar Pro settings, or from your Stripe receipt email.

D. Free Trials & Refunds

Any unused portion of a free trial period is forfeited when a paid subscription begins. Refunds for Apple App Store (iPhone) purchases are subject to Apple’s standard policies and must be requested directly from Apple. Refunds for Mac purchases processed through Stripe are handled by us in accordance with applicable consumer law — please contact us to request one.

5. AI Processing & Limitation of Liability.

Klar uses artificial intelligence algorithms (via OpenAI API) to transcribe mowa and format text. While we strive for high accuracy, machine transcription may occasionally misinterpret spoken words or contain grammatical inaccuracies.

• User Responsibility: You are solely responsible for reviewing, verifying, and editing any generated text before sending, publishing, or relying on it.
• "AS IS" Disclaimer: The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.
• Limitation of Liability: To the maximum extent permitted by applicable law, Jakub Mieczkowski shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Service.

6. Prohibited Conduct.

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to discover the source code of the Klar application.
• Use automated tools, bots, or scripts to overload, scrape, or interfere with backend APIs.
• Use the Service for any unlawful, fraudulent, or malicious purpose.

7. Privacy Policy.

Your privacy is paramount to us. Please refer to our Privacy Policy for information on how we handle audio data with zero server retention.

8. Changes to the Terms.

We reserve the right to modify these Terms at any time. Updated terms will be posted on this page with an updated revision date. Your continued use of Klar after changes become effective constitutes acceptance of the new Terms.

9. Governing Law & Jurisdiction.

These Terms shall be governed by and construed in accordance with the laws of Poland, without giving effect to any principles of conflicts of law. This does not deprive consumers of any mandatory protection afforded to them under the laws of their country of residence.
